1. Who We Are

Happy Sisyphus Productions Ltd is a UK-registered company (Company No. 14730663) that produces immersive games and media. We are the data controller for any personal information collected through our website or applications.

2. Scope of This Policy

This policy applies to:

• The Happy Sisyphus Productions website (happy-sisyphus.com)

• The VR game Colors of Our Memories (Meta Quest and Steam)

• Tales of the Forgotten: Echoes — our web app, and our upcoming iOS and Android apps

• Crowdfunding campaigns operated via Kickstarter

• Promotional competitions and giveaways operated via Gleam.io

• Beta testing programs for Tales of the Forgotten: Echoes, run via Google Forms (see Section 3e)

3. What Information We Collect

3a. Website

When you visit our website, we and our third-party partners may automatically collect:

• Device and browser information (e.g. IP address, browser type, operating system, time zone)

• Usage data (pages visited, time on page, referring URLs, click behaviour)

• Cookies and tracking technologies (see Section 4 for full details)

You may also voluntarily provide personal data — such as your name, email address, or organisation — when:

• Subscribing to our newsletter

• Contacting us via forms

• Entering competitions or giveaways via Gleam.io

• Supporting a crowdfunding campaign via Kickstarter

3b. Colors of Our Memories (Game)

We do not collect or store any personally identifiable information (PII) through the game. We may collect limited anonymised gameplay data solely to improve performance and player experience, including:

• Play duration and level progress

• Device type (e.g. Meta Quest 2/3, PC VR via Steam)

• General settings used (e.g. graphics options)

All gameplay analytics are anonymised and never shared with third parties.

3c. Kickstarter Campaigns

When you visit our campaign pages on Kickstarter, Kickstarter's own data practices apply and are governed by Kickstarter's Privacy Policy. We may receive aggregated campaign analytics and backer data (such as email addresses of backers who opt in to communications) in accordance with Kickstarter's platform terms.

3d. Gleam.io Competitions and Giveaways

When you enter a competition or giveaway hosted via Gleam.io, Gleam collects and processes your data on our behalf. Data collected may include:

• Name and email address

• Social media profile information (for entry methods requiring social login or actions)

• IP address and device data

Gleam.io is a third-party data processor. Their processing is governed by Gleam's Privacy Policy, available at gleam.io/privacy. We use data collected through Gleam solely for the purposes of running the competition and, where you have opted in, adding you to our mailing list.

3e. Tales of the Forgotten: Echoes (Web App, iOS, and Android)

When you use Tales of the Forgotten: Echoes, we may collect:

• Account data: your email address and, if you create a password, an encrypted version of it. If you sign in via Apple or Google, we receive a token confirming your identity rather than your password. Accounts are managed for us by Supabase (see Section 7).

• Conversation content: the messages you send to historical figure personas within the app, and the AI-generated responses you receive. Currently, all conversations are text-based. See Section 3f for how this content is processed and Section 7 for where it's stored.

• Voice data (future feature — not yet available): we plan to introduce optional voice input and spoken responses as a paid feature. When this launches, we (or a voice processing provider we'll name here) will collect audio recordings of your speech and/or generate spoken audio responses. This policy will be updated with the relevant provider and processing details before that feature goes live.

• Usage and device data: app version, operating system, device type, crash reports, session length, and which features and personas you use. Technical crash and error data is collected via Sentry.

• Ad interaction data: if you choose to watch a rewarded video ad to unlock additional conversations, our ad partner collects data about that ad interaction. We currently use Google Ad Manager and AdSense for rewarded video ads on the web app. For the iOS and Android apps, we plan to use AppLixir or a comparable mobile ad delivery service. See Section 7 for details.

• Subscription and payment data: if you subscribe to a paid tier, this is handled via RevenueCat together with the Apple App Store or Google Play billing systems. We receive confirmation of your subscription status via RevenueCat but do not receive or store your card details.

3f. How We Use AI to Process Your Conversations

Tales of the Forgotten: Echoes works by sending the messages you type to a third-party AI provider — currently Google, via its Gemini API — which generates the in-character response you receive. This means:

• Your conversation content is transmitted to and processed by Google as part of how the app functions. This processing is essential to the service — it is not something you can opt out of and still use the conversation feature.

• The specific Gemini model used to generate responses may vary depending on your subscription tier. This affects response quality and speed but does not change how your data is handled.

• Google processes this data as our processor, under the Gemini API Terms of Service and Google Privacy Policy.

• In addition to processing by Google to generate responses, your conversation transcripts are stored by us via PostHog for the purposes described in Section 3h. When voice features launch in future, this section will be updated to name the relevant voice processing provider.

3g. Beta Testing Program

Before general release, we invite a limited number of fans to test Tales of the Forgotten. If you sign up for this beta program via our Google Form, we additionally collect:

• Your email address

• Confirmation that you are 18 years of age or older

• Your country of residence

• The device you intend to test on (Android/iOS/desktop)

• Your consent to the terms below

During the beta test period only, conversations you have within the app are reviewed by our team, in addition to being processed by our AI provider as described in Section 3f. This is separate from and in addition to standard AI processing — a member of our team may read chat transcripts to improve persona quality, identify bugs, and assess safety. Your conversations during the beta period are not private. Beta participants are asked to provide separate, explicit consent to this before taking part, and are advised not to share anything in-app that they would not want a member of our team to read.

Beta participants who consent are also contacted by email for a short follow-up survey after the test period, under separate consent collected on the same form.

3h. Conversation Privacy at General Release

Once Tales of the Forgotten: Echoes exits beta testing, the beta-specific review described in Section 3g no longer applies. From general release onward:

• We do not routinely read or review your conversations. Members of our team do not browse or sample user chats as a matter of course.

• We use automated systems to scan conversations for indicators of serious risk — for example, content suggesting a risk of harm to yourself or others, attempts to misuse the service, or illegal content — so that we can respond appropriately and meet our legal obligations.

• We reserve the right to access specific conversations where necessary to investigate a reported violation of our Terms of Service, respond to a safety concern, comply with a legal request, or resolve a technical issue you've reported to us. Any such access is limited to what's necessary for that purpose.

• Your conversation content is still transmitted to Google (Section 3f) to generate responses, and is stored via PostHog as described in Section 5, regardless of whether it is ever reviewed by a person.

4. Cookies and Tracking Technologies

We use cookies and similar tracking technologies on our website, and comparable tracking technologies within Tales of the Forgotten: Echoes, for the purposes described below. Under UK law (UK GDPR and PECR), non-essential cookies require your prior consent. You can manage your preferences at any time via the cookie settings banner on our website.

4a. Essential Cookies

These cookies are necessary for the website to function and cannot be switched off. They include session management and security cookies. No consent is required for these.

4b. Analytics Cookies — Google Analytics

We use Google Analytics (provided by Google Ireland Ltd / Google LLC) to understand how visitors interact with our website. Google Analytics uses cookies to collect information such as:

• Pages viewed and navigation paths

• Session duration and bounce rate

• Approximate geographic location (country/region level)

• Device and browser type

This data is aggregated and anonymised where possible. We have enabled IP anonymisation. Google may transfer data to the United States; this is covered by appropriate safeguards including Standard Contractual Clauses. Legal basis: Consent (PECR / UK GDPR Art. 6(1)(a)). You can opt out at any time via our cookie settings.

4c. Marketing and Conversion Cookies — Meta Pixel

We use the Meta Pixel (provided by Meta Platforms Ireland Ltd / Meta Platforms Inc.) to measure the effectiveness of our advertising campaigns and to enable retargeted advertising on Facebook and Instagram. The Meta Pixel may collect:

• Pages you visit on our site

• Actions you take (e.g. clicking a campaign link, signing up to our newsletter)

• Device information and identifiers

• Your IP address (hashed)

This data is shared with Meta and may be used to show you relevant advertising on Meta’s platforms. Meta may transfer data to the United States under Standard Contractual Clauses. For more information, see Meta’s Data Policy at facebook.com/policy.

Legal basis: Consent (PECR / UK GDPR Art. 6(1)(a)). You can withdraw consent at any time via our cookie settings.

4d. Campaign Referral Tracking

We may use UTM parameters and referral tracking links to measure traffic from our Kickstarter campaigns, social media posts, and partner channels. This helps us understand which marketing activities are driving interest. This data is processed within Google Analytics and does not involve additional cookies beyond those described in Section 4b.

4e. Managing Your Cookie Preferences

When you first visit our website, a cookie consent banner will ask for your preferences. You can:

• Accept all cookies

• Reject non-essential cookies

• Manage individual category preferences

You can update your preferences at any time by clicking the “Cookie Settings” link in our website footer. Please note that rejecting non-essential cookies will not affect your ability to use our website, but some features (such as personalised advertising) will be disabled.

4f. Tracking Within Tales of the Forgotten: Echoes

The app itself (web, iOS, and Android) does not use traditional browser cookies in the same way our website does, but it does use comparable tracking technologies:

• PostHog collects in-app usage and product analytics data (e.g. which features and personas you use, session activity) as described in Section 3e.

• Ad delivery partners (Google Ad Manager/AdSense on web; AppLixir or similar on mobile) may use device identifiers or similar technologies to deliver and measure rewarded video ads.

• RevenueCat and app store billing systems use identifiers necessary to manage your subscription.

• On iOS, where Apple's App Tracking Transparency framework applies to any tracking across other companies' apps and websites, we will request your permission in accordance with Apple's requirements before any such tracking takes place.

Where consent is legally required for any of the above (rather than being necessary for the app to function), we will ask for it within the app before the relevant tracking begins.

5. Why We Process Your Information

We process only the data necessary for the following purposes:

• Maintaining and improving our website, games, and apps

• Generating in-app AI conversations (Tales of the Forgotten)

• Understanding aggregate user behaviour and improving our content

• Measuring the performance of our marketing campaigns (including Kickstarter and social media advertising)

• Running competitions, giveaways, and beta testing programs, and contacting participants

• Sending newsletters, campaign updates, and beta survey requests to those who have opted in

• Delivering rewarded video ads within Tales of the Forgotten: Echoes to unlock additional features (Google Ad Manager/AdSense on web; AppLixir or similar on mobile)

• Retargeted advertising to people who have previously visited our website (Meta Pixel, consent only)

• Investigating and responding to safety concerns, abuse of the service, or violations of our Terms of Service

• Identifying and resolving technical issues

• Complying with legal obligations or defending legal claims

6. Data Retention

We retain personal data only for as long as necessary to fulfil the purposes outlined in this policy, or as required by law:

• Newsletter subscriber data: retained until you unsubscribe

• Competition entrant data: retained for 12 months following the competition close date, unless you have opted into our newsletter

• Website analytics data (Google Analytics): retained for 26 months by default

• Meta Pixel event data: retained per Meta's standard data retention policies

• Anonymised gameplay data: may be kept indefinitely for analytics purposes

• Beta program signup data (email, age confirmation, country, device, consent records): retained for 12 months after the beta period ends, or until you request deletion

• Beta conversation transcripts reviewed by our team: retained for 12 months after the beta period ends, for app improvement purposes, unless you request deletion sooner

• Conversation content processed by Google (Gemini API) to generate responses: retained per Google's own data retention terms as our processor, set out in the Gemini API Terms of Service

• Conversation transcripts stored by us via PostHog (general release, post-beta): retained for 6 months, sufficient to support automated safety scanning and investigate reported issues, after which transcripts are deleted or anonymised

• Account data (Supabase): retained for as long as your account is active, plus 30 days after deletion to allow recovery of an accidentally deleted account

• Technical crash/error data (Sentry): retained for 30 days, per Sentry's Free (Developer) plan retention policy

7. Legal Basis for Processing (UK/EU Residents)

We rely on the following legal bases under UK GDPR:

• Consent — for non-essential cookies (Google Analytics, Meta Pixel), newsletter sign-ups, and competition entry data

• Legitimate Interests — for essential website operation and anonymised analytics that do not require consent

• Contractual Necessity — when you contact us regarding services or support

• Legal Obligation — where required by applicable law

Where we rely on consent, you have the right to withdraw it at any time without affecting the lawfulness of processing prior to withdrawal.

8. Third-Party Processors

We share your data with the following third-party processors, strictly for the purposes described in this policy:

• Google LLC / Google Ireland Ltd — Google Analytics (website analytics); cookie consent management; Google Ad Manager and AdSense (rewarded video ads, web app); Gemini API (AI language model processing for in-app conversations in Tales of the Forgotten: Echoes)

• Meta Platforms Inc. / Meta Platforms Ireland Ltd — Meta Pixel (advertising measurement and retargeting)

• Gleam.io — competition and giveaway management

• Kickstarter, PBC — crowdfunding campaign platform

• Kit (formerly ConvertKit) — email newsletter management

• Supabase, Inc. — user account management and authentication for Tales of the Forgotten: Echoes

• PostHog Inc. — storage of in-app conversation history and product usage analytics for Tales of the Forgotten: Echoes

• Functional Software, Inc. (Sentry) — technical error and crash reporting for Tales of the Forgotten: Echoes

• Hostinger — web hosting for the Tales of the Forgotten: Echoes web app and our website

• RevenueCat, Inc. — subscription management, working alongside Apple App Store and Google Play billing

• Apple Inc. / Google LLC — app store distribution and subscription billing

• AppLixir (or a comparable mobile ad delivery service) — rewarded video ad delivery within the Tales of the Forgotten: Echoes iOS and Android apps, once launched

We do not sell your personal data to any third parties, and we do not permit third-party processors to use your data for their own independent marketing purposes without your separate consent.

9. Your Rights

Regardless of your location, you have the following rights related to your personal data:

• The right to access your personal data

• The right to rectify incorrect or outdated information

• The right to deletion (the "right to be forgotten")

• The right to object to certain types of processing (including direct marketing)

• The right to restrict processing in certain circumstances

• The right to data portability, where applicable

• The right to withdraw consent at any time (where processing is based on consent)

• The right to lodge a complaint with the ICO (ico.org.uk) if you are in the UK

10. Children’s Privacy

Our website and general services are not directed at children under 13, and we do not knowingly collect personal data from them. If we become aware that we have inadvertently collected such data, we will take prompt steps to delete it.

Tales of the Forgotten: Echoes requires users to be at least 13 years of age to create an account and use the app. This is confirmed via an age-gate checkbox at signup.

Some countries set a higher age at which a person can independently consent to an online service processing their data — under EU law this can be anywhere from 13 to 16 depending on the country. If you are located in a country where the applicable age of consent for online services is higher than 13, you confirm, by using Tales of the Forgotten: Echoes, that you have your parent or legal guardian's permission to do so. We rely on your confirmation at signup and do not independently verify age or parental consent beyond this. This is a standard, widely-used approach for consumer apps operating across many jurisdictions at once — it isn't a bulletproof solution, but it is a reasonable and defensible way to give most 13+ users worldwide access while still putting the higher-age requirement in some countries on the record. If your risk tolerance changes as the app grows, this is a section worth revisiting with a lawyer, particularly if you begin targeting under-16 users more directly (e.g. through marketing) in countries with a higher threshold.

11. International Transfers

Some of our third-party processors — including Google (including the Gemini API), Meta, Sentry, and RevenueCat — are based in, or transfer data to, the United States. Where personal data is transferred outside the UK or EU, we ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) as approved by the UK ICO or the European Commission. Our Supabase (user accounts) and PostHog (conversation history) instances are both hosted within the EU, so data held with these processors does not involve an international transfer. For more information on the safeguards used by specific processors, please refer to their respective privacy policies.

12. Information Security

We use reasonable physical, technical, and administrative safeguards to protect the data we collect. However, no method of transmission over the internet or data storage system is 100% secure. Please use our services, including Tales of the Forgotten, with awareness of this limitation — in particular, please avoid sharing sensitive personal information (financial details, health information, or similar) in conversations with app personas.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be notified via a notice on our website and/or in-app, and the "Last Updated" date at the top of this document will be revised. We recommend reviewing this policy periodically. We expect to update this policy again when voice features launch, and to remove the beta-specific language in Sections 3g and elsewhere once the beta program has formally ended.
